In Malpractice Suit, Teresa Giudice's Blames Attorney for Landing Her Behind Bars
A Superior Court judge has paved the way for Teresa Giudice's malpractice suit against her former bankruptcy attorney to move forward.
The "Real Housewife of New Jersey" star has been openly critical of onetime attorney James Kridel, even going as far as to directly blame him for the bank fraud conviction that led to her spending nearly a year behind bars.
In formal court documents, the 43-year-old Giudice accuses Kridel of being guilty of breach of contract, breach of fiduciary duty and legal malpractice in his handling of her now six year old case.
James Kridel Accused of Making 'Material Errors'
In addition, current lawyer Carlos Cuevas charges Kridel with making "material errors" in his handling of his new client's case.
Namely, Cuevas takes issue with Kridel not listing such key revelations as Giudice's job, income, and various auto and property assets on legal documents before letting her sign off on them as accurate "under penalty of perjury."
After pleading guilty, Giudice served close to a year at the Danbury Correctional facility. After she was released just before Christmas, she served an additional six weeks of house arrest.
Joe Giudice Currently Serving Time After Similar Conviction
Currently, Giudice's husband, Joe, is serving a 41-month sentence at the Federal Correctional Institute on similar charges and could face deportation proceedings back to his native Italy whenever he is released.
Soon after the suit was formally filed, Kridel publicly took exception with the allegations raised by Giudice, arguing "Teresa went to jail because she committed crimes."
He later added, "She had about 2.5 hours of testimony before she went to jail where she took full responsibility for the crimes."
With the judge ruling that the case can now go forward, the discovery phase is soon expected to commence with a trial date likely to fall sometime over the next 18 months.
Since being released, Teresa Giudice has returned to starring on "Real Housewives."
