Pres. Joe Biden Blocked by Court to Lift Title 42 Expulsion Before May 23
President Joe Biden and his administration were blocked by Louisiana federal court on Monday to rescind the Title 42 expulsion on the U.S.-Mexico borders before May 23.
According to New York Post, the Louisiana Federal court made the move by issuing a temporary restraining order (TRO) against Biden and his administration.
The move from the court was announced by Missouri Attorney General Eric Schmitt through a statement, claiming that the move was a big victory for border security. However, the attorney general noted that the "fight continues on."
Fox News reported that the TRO will prevent the Biden administration take any action regarding the Trump-era border policy before a hearing on May 13, which will determine whether the public health order can be lifted on May 23.
Arizona Attorney General Mark Brnovich lauded the court's move on Monday, contending that Biden and his administration cannot continue to disregard the existing laws and procedures.
However, neither the Centers for Disease Control and Prevention (CDC) nor the Biden administration has proposed lifting the Title 42 expulsion earlier than May 23.
Republican States of Louisiana, Missouri, Arizona, on Title 42 Expulsion Ending
The TRO issued by the federal court in Louisiana came after officials from Arizona, Missouri, and Louisiana filed a lawsuit against the Biden administration, claiming that ending the program would overwhelm the agency's capacity to enforce immigration laws at the border.
Fox News noted that several other states have joined the three Republican states in the lawsuit, but the outlet did not mention which states are on board in the suit.
The lawsuit filed named several agencies under the Biden administration as defendants, including the immigration court system.
Pushbacks on Pres. Joe Biden's Ending of Title 42 Expulsion
Several officials have expressed their opposition to President Joe Biden and his administration's plans to end the Title 42 expulsion.
One of them was Republican Senator Ron Johnson from Wisconsin, claiming that the Biden administration is creating a disaster by "throwing open" the country's borders, ripping the administration on the upcoming rescindment of the Trump-era program, per the Post.
Johnson said that the move from the Biden administration will allow human traffickers to "pocket billions of dollars," adding that a nation is not considered sovereign if the border is not secure.
New York Representative John Katko also highlighted the effects of the removal of Title 42 expulsion, claiming that the daily migrant encounters would increase to 18,000 if the move is pursued.
CDC announced earlier this month that it would remove the Title 42 expulsion that will be effective on May 23.
The agency added that the decision was made after considering the current public health conditions in the U.S. as well as the increase in the availability of the tools in combatting COVID-19.
