Kim Kardashian could reportedly "win full custody" of her four kids amid her messy divorce with Kanye West. Legal experts told The U.S. Sun that the rapper made a major mistake when he opted not to turn up to his scheduled deposition on November 16 following his anti-Semitism scandal.

The U.S. Sun has obtained court documents showing that Kim's defense team still has one last shot to question Kanye on November 29. His lawyer has agreed to this.

The custody of the rapper's four young children namely North, 9; Saint, 6, Chicago, 4; and Psalm, 3 might be significantly affected if Kanye decides not to appear again, according to New Jersey-based family law attorney Lexie Rigden of Rigden Law LLC.

Rigden told The U.S. Sun that if the rapper refuses to show up to his deposition, "the judge could sanction him monetarily, make him pay counsel fees, and if it is an egregious enough discovery violation, the judge may be able to bar him from putting on a case at trial."

Rachel Fiset, the managing partner of Zweiback, Fiset & Zalduendo LLP, also told the outlet that if Kanye was trying to avoid giving information that would hurt his divorce case by not attending a deposition, "a judge might automatically determine that the bad information is a fact inside of the trial because he was uncooperative."

Rigden noted that Kanye's negative public comments about Kim and her family, as well as his ridiculous suggestions like sending the kids to two different schools at once, will likely be used to show that he is unable to reasonably co-parent and does not have the best interests of the kids in mind.

Fiset continued: "Overall, this can hurt his case. In the most severe instance, the judge can rule against him and he could get a lesser custody award and a less favorable monetary disposition."

"But more likely, the judge will simply determine that the facts Kim Kardashian alleges are true, and not give him the chance to defend himself," she added.

Kim Kardashian said she is fine with giving Kanye West 50/50 custody, but the rapper has publicly berated her on social media, saying she has the kids most of the time.

Kanye West Lawyer Files a 'Declaration of Disclosure'

Last month, Kanye West's lawyer reportedly filed a "declaration of disclosure," a sign that the case was nearing a conclusion.

Citing court documents, Daily Mail reported that Kanye has handed over to Kim Kardashian's legal counsel all of his financial information and has also reached an agreement with her on how they will divide their finances and property.

The former couple is trying to work out how to divide up and share their more than $2 billion in combined assets after seven years of marriage.

Kanye is represented by Nicholas Salick, his sixth attorney, while Laura Wasser, a famous divorce lawyer, represents the reality star. Court documents showed that there will be a two-day trial in December, beginning on the 14th after Kanye's last chance to appear in court on November 29.

Kim filed for divorce from Kanye in February last year. At that time, attorneys for the reality star noted that Kim Kardashian "has no desire" to reconcile with Kanye West and wants their marriage terminated, despite sharing four kids while being together.

Kanye West Tackles Custody Battle With Kim Kardashian Through Song

Kanye West earlier addressed his ongoing custody battle with Kim Kardashian through his song, "True Love." The rapper expressed his feelings about the subject in his song that was released last May 27. Kanye said he feels like his children are "borrowed" whenever he picks them up.

"Wait, when you see the kids? I'll see y'all tomorrow/ Wait, when the sunset? I see y'all tomorrow/ Wait, when I pick 'em up, I feel like they borrowed," the rapper noted in the song's first verse.

Kanye went on to say that whenever he returns the kids, "scan 'em like a barcode."

"Wait, no hard feelings, but these feelings hard though/ Wait, who got the kids in those 'What are those?'" he continued to rap.

Kanye West has previously claimed that he was barred from seeing his kids. But Kim Kardashian denied it and urged him to stop telling that narrative as it was not true. 

Kim was declared legally single last March, more than a year after filing for divorce from Kanye. But Kanye West and Kim Kardashian are still locked in a custody battle amid their ongoing divorce.
