Halle Berry, Olivier Martinez Divorce Update: Couple Already Warring in Proceedings
Halle Berry and Olivier Martinez's pending divorce is shaping up to be a contentious affair, as the two can't even agree on who rightfully served the other first to commence proceedings.
According to TMZ, each hit the other with a petition within hours of one another this week, but there is now some question over the legality of Berry's filing. She used aliases to identify both parties and actually handed the documents to Martinez herself, a clear breach of California divorce law, which stipulates one party of divorce can't serve the other.
It has become painfully clear that the couple's short-term union has run its course. Both cited irreconcilable differences in their respective filings. They later released a joint statement, which read, "We move forward with shared focus of what is best four son."
People Magazine reports Berry is not seeking child support, while Martinez requests that the issue be resolved at a later time. As per their prenup, Berry maintains all of her earnings and assets as her property.
As for 2-year-old son Maceo, both parents are seeking joint custody, though Berry has attached the stipulation that Martinez provide transportation to and from all visits and gain her permission before taking their son out of state.
The two met on the set of the movie "Dark Tide" in 2010, and three years later became man and wife. Their son was born in October 2013.
Sources indicate the dissolution of their union was brought on by a number of factors. Chief among them were their living situation and Martinez's notoriously bad temper.
Word is Berry desperately wanted to raise her two children abroad. However, she has a daughter from another relationship and was never able to make the move because of ongoing custody issues with the father, Gabriel Aubry.
Martinez is rumored to have never cared for the LA scene or wanted to live there full time.
As for his temper, in 2012 Martinez was involved in a brawl with Aubry. More recently, he was caught shoving an LAX employee holding a baby seat, which resulted in the couple being sued for $5 million.
The divorce marks the third for Berry, who was previously married to baseball star David Justice and singer Eric Benét, while it is Martinez's first split.
