The Joe Biden classified documents case has now wrapped up, with the special counsel overseeing the case admitting the POTUS would not be charged. The case's result also showed how different the Biden case is from the Donald Trump case, which is currently being investigated, and more evidence of the former president's wrongdoing surfacing.

Attorney General Merrick Garland appointed two separate special counsels to investigate the Biden case and the Trump case, but the two had wildly differing results. While special counsel Robert Hur declined to say that the president should be charged, special counsel Jack Smith found that former President Donald Trump violated the Espionage Act as a private citizen and conspired with others to obstruct justice.

While Hur found that Biden's poor memory resulted in the president retaining classified documents that "present serious risks to national security," he added that the evidence his team found "does not establish Mr. Biden's guilt beyond a reasonable doubt."

According to NBC News, Hur also revealed that there were clear "material distinctions" between a theoretical case against Biden and the pending case against Trump, as the case against the former president over his retention of classified documents has e "serious aggravating facts."

Joe Biden did hit back at Hur's comment about his memory, saying, "The decision to decline criminal charges was straightforward, but my memory's fine."

Why Is the Donald Trump Case Different from the Joe Biden Classified Documents Case

Donald Trump has always alleged that there is a "two-tiered system of justice and unconstitutional selection prosecution," with the government often prosecuting him over Biden and his allies. However, there are some very stark differences between the Joe Biden classified documents case and his classified documents case.

While the cases seem similar in nature, they are different as well, since the Biden case is more about the president forgetting about the classified documents at his Delaware home while serving as Vice President and giving those documents up willingly, while Trump made a concerted effort to hide these documents that he willfully but illegally retained.

However, an ABC News analyst pointed out that there was no difference in how both of these cases were approached. Only if Biden obstructed Justice and hid the documents like Trump would have resulted in the POTUS being prosecuted.

Joe Biden Did Not Hoard and Hide Classified Documents, Donald Trump Did

Special counsel Hur admitted that he did not have enough evidence that Biden had willfully retained the classified documents found in his Delaware home's garage, as the president could just chalk it up to forgetting about them because of his age. He also returned said documents promptly to authorities.

However, as Hur's report also stated, "Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite."

Trump is accused of ordering several Mar-a-Lago workers to intentionally hide classified documents from his own lawyers so they would not be able to return them to the government. This led to his obstruction of justice indictment.

As the AP noted, he schemed with his valet, Walt Nauta, and a Mar-a-Lago property manager, Carlos De Oliveira, to conceal security camera footage of them moving these classified documents after a subpoena was released.
