TMZ reports that the Olympic swimmer has been arrested twice in 10 years for driving under the influence.
Phelps' second DUI arrest occurred early last Tuesday Sept. 30 where he was pulled over in Baltimore for speeding and crossing double lanes.
According to TMZ, police also noticed that Phelps appeared to be "hammered." Police later confirmed his intoxicated state by issuing a sobriety test that Phelps failed.
Phelps' first DUI arrest occurred back in 2004 in Salisbury, Maryland, CNN reports. Following his arrest, Phelps appeared in court pleading guilty and was sentenced to 18 months probation.
Five years later in 2009, a photograph of Phelps smoking marijuana at a party surfaced creating frenzy among his fans and the media.
At the time, ESPN reported that the U.S. Olympic Committee issued a statement expressing their disappointment over "the behavior recently exhibited by Michael Phelps" who they described as a "role model...well aware of the responsibilities and accountability that comes with setting a positive example for others."
Phelps also issued his own statement regarding his "mistakes."
"I'll make a million mistakes in my life, but as long as I never make the same mistake again, then I've been able to learn and grow," Phelps said in a 2012 statement obtained by CNN.
According to CNN, Phelps revealed that the incident "made him realize who his real friends were."
Phelps has yet to disclose when he will enter treatment and what rehab he will attend.
