Bethenny Frankel is appealing a Manhattan judge's decision that allows ex-husband Jason Hoppy to continue living in the Tribeca apartment they once shared.

According to Radar, though Frankel admits the two purchased the home through a trust, she claims they used all her money to do so. She further contends now that the trust has been invalidated, "the person supplying the money" should be awarded the property.

In addition to arguing the court erred in allowing Hoppy to continue living in the residence, Frankel is also seeking to have terminated the spousal support she is now required to pay her ex. Lawyers for the "Real Housewives of New York" star argue both parties previously agreed not to seek support from the other.

"On March 12, 2010 the parties executed their Prenuptial Agreement in which they mutually waived spousal maintenance from the other 'both now and in the future,'" Frankel's attorneys said. "The award of any temporary maintenance, even for one year, was error as a matter of law."

As for the purchase of the Tribeca apartment, Frankel insists she never met or even visited the offices of the attorney who witnessed her signature, bringing into question the signature now on the documents assumed to be hers. Documents also point out Hoppy's mother served as a notary on the documents, claiming to be a notary in New York, when in fact she is a notary in Pennsylvania.

Frankel and Hoppy were married for just three years and have a young daughter together. During a recent episode of "Real Housewives," the 43-year-old star broke down over just how tough things have recently been for her.

"Whatever my situation is, it's pretty f*cking bad and it's my own thing," she said as tears streamed down her face. "And I can't do it."
