Former San Francisco 49ers Ray McDonald Indicted on Rape Charge
Former San Francisco 49ers defensive lineman, Ray McDonald, is facing up to eight years in prison after a grand jury indicted him on a charge of raping an intoxicated woman last Dec. 15, the Associated Press has learned.
McDonald surrendered to the Sheriff's office but was released on a $100,000 bond and is scheduled for arraignment on Sept. 25.
Current 49ers linebacker, Ahmad Brooks, was also charged by the Santa Clara County District Attorney's Office with misdemeanour sexual battery, stemming from an alleged assault involving the same victim on the same day. He is facing a maximum of six months in prison and will be registered as a sex offender; however, a schedule for an arraignment has not been released as reported by San Jose Mercury News.
The 49ers have sent Brooks home from Denver, Col., where joint practices with the Broncos are being held. San Francisco is scheduled to play a preseason game against Denver on Aug. 29.
The 49ers' general manager, Trent Baalke, said in a statement released by the team via NFL.com, "The organization is aware that a misdemeanour charge has been filed against Ahmad Brooks stemming from a December 2014 matter. We take any charge against a member of this organization seriously and are in communication with the NFL."
According to the Associated Press, the woman's civil lawsuit filed in May against both men stated that McDonald carried her upstairs to his bedroom and sexually assaulted her while Brooks was groping her while she was unconscious.
The woman also said that she slipped and fell on a pool deck at McDonald's house and continued to fall due to her initial head injury and too much alcohol intake. McDonald initially thought she was dead and did not call 911 because he did not want a dead woman on his property.
McDonald was also indicted for violating a restraining order from a May 25 incident involving a different woman. He was arrested for allegedly breaking down a bedroom door to get to his former fiancée and their baby.
According to Bleacher Report, the 30-year-old defensive lineman was released by the 49ers last December before signing with the Chicago Bears. The Bears released him following his arrest on May 25.
San Jose Mercury News reported that the incidents of McDonald and Brooks were the latest off-field legal issues involving 49ers players. Linebacker Aldon Smith was released by the 49ers on Aug. 7 after a hit-and-run and drunk driving accident.
Fullback Bruce Miller was involved in a domestic violence charge with his ex-fiancée last March. Wide receiver Jerome Simpson was suspended by the NFL for the first six games of the incoming season for violating NFL's substance abuse policy.
