Kristine Rodas, the widow of Roger Rodas who died with actor Paul Walker while speed racing, is suing German automobile company Porsche for its alleged responsibility in the fatal crash.

During the time of the fatal incident, Rodas and Walker had been driving a 2005 Porsche Carrera GT.

Soon after their tragic deaths, reports surfaced that the men had been racing at an "unsafe speed" that caused them to crash.

"Investigators determined the cause of the fatal solo-vehicle collision was unsafe speed for the roadway conditions," Los Angeles County Sheriff's Commander Mike Parker told CNN last year.

He continued by explaining that the high-performance 2005 Porsche Carrera GT was going "between 80 and 93 mph at the time the car impacted a power pole and several trees. The posted speed limit on the Santa Clarita, California, office park road was 45 mph.

Despite reports that speed killed the two men, Kristine is claiming otherwise.

Kristine, who filed the lawsuit on Monday at the L.A. County Superior Court, claims that that the Porsche did not have proper crash or safety features in the gas tank.

The Hollywood Reporter reported that according to the legal documents, the vehicle did not have a "fuel cell," which is found in many race cars.

The fuel cell stops the fuel from igniting in the event of a car crash.

The lawsuit also contends that the car has a failure in its suspension system that forced it to careen out of control and strike three trees while driving down a street in Santa Clarita, California.

Paul Walker died on Nov. 30, 2013, at the age of 40. During the time of his death, Walker had been filming "Fast & Furious 7."

Universal Pictures is now enlisting the help of his brothers, Cody and Caleb Walker, to finish some of the action scenes.

"Fast and Furious 7" stars Vin Diesel, Michelle Rodriguez, Tyrese Gibson and Chris "Ludacris" Bridges. It is slated for release April 10, 2015.
