Donald Trump's legal losing streak continues as a judge dismissed his counter-defamation lawsuit against columnist E. Jean Carroll. The judge noted that Carroll's claim that Trump raped her is "substantially true."

Trump's lawyers claimed that E. Jean Carroll defamed their client during an interview after a jury found Donald Trump liable for sexual abuse in a civil lawsuit from the former Elle Magazine columnist. He was not found liable for rape but US District Judge Lewis Kaplan ruled that what Carroll said in that interview is true.

In his ruling, Jude Kaplan stated that the jury found Trump raped Carroll "as the term is understood more broadly." He added that while the jury concluded Trump was not liable for rape according to New York's penal code, the jury found that his act of sexually abusing her by forcefully inserting his fingers was an "implicit determination that Mr. Trump digitally raped her."

According to CBS News, the judge previously concluded in his July 19 decision that "Mr. Trump did in fact digitally rape Ms. Carroll." The judge also wrote in his decision, "The definition of rape in the New York Penal Law is far narrower than the meaning of 'rape' in common modern parlance, its definition in some dictionaries, in some federal and state criminal statutes, and elsewhere."

Why Did Donald Trump File a Defamation Lawsuit Against E. Jean Carroll?

After winning the case, E. Jean Carroll's lawyer, Roberta Kaplan, who is not related to the judge, sat down with several outlets and stated that Trump indeed raped her client. Carroll reportedly also told one of Trump's attorneys, "He did it and you know it."

Carroll and her attorney then went on doing several interviews, and they both stated that Trump raped her. This then led to Trump filing the now-dismissed countersuit where he claimed Carroll "made these statements knowing each of them were false or with reckless disregard for their truth or falsity."

Carroll's attorney, Roberta Kaplan, stated that she was pleased with the judge's decision to throw the countersuit out while Trump lawyer Alina Habba stated, "We strongly disagree with the flawed decision and will be filing an appeal shortly."

Donald Trump on a Losing Streak Against E. Jean Carroll

Trump seems to be suffering a string of legal defeats against E, Jean Carroll specifically, as he not only lost the civil rape case against her but she also won against him with this defamation suit he filed.

However, that is not the only legal loss Trump suffered against Carroll, as back in July, after losing the case against the former columnist, the former president tried to have a new trial that would have overturned the verdict that he is liable for sexually assaulting her. He lost that one as well, according to NPR.

In his decision, Senior District Judge Lewis A. Kaplan wrote that the jury did not reach "a seriously erroneous result" and its verdict is not "a miscarriage of justice," as Trump stated in his filing for a new trial.
