SB4, the controversial Texas immigration law has been temporarily blocked by a federal judge before it could take effect on Tuesday.

SB4 would have allowed police to arrest anybody they suspect is an illegal immigrant and for judges to deport them.

US District Judge David Ezra issued a preliminary injunction that stops the controversial Texas law from being enforced when it is scheduled to take effect on Tuesday. This means that SB4, or Senate Bill 4, will not take effect while the court proceedings are playing out.

In his order to suspend the law from being enforced, Judge Ezra wrote that the federal government "will suffer grave irreparable harm" if the law took effect, as other states could be inspired to pass their own immigration laws should it be enforced.

Should other states follow Texas's example, the judge warned that it could create "an inconsistent patchwork of rules about immigration" as the federal government has the sole responsibility to enforce immigration law, as stated in the Constitution, according to the Texas Tribune.

"SB 4 threatens the fundamental notion that the United States must regulate immigration with one voice," the judge wrote in his order to suspend. He added that should the state arrest and deport migrants who may be eligible for political asylum, that would violate the Constitution, as well as being e "in violation of US treaty obligations."

"Finally, the Court does not doubt the risk that cartels and drug trafficking pose to many people in Texas," he added. "But as explained, Texas can and does already criminalize those activities. Nothing in this Order stops those enforcement efforts," before further blasting the Greg Abbott-supported law by adding, "No matter how emphatic Texas's criticism of the Federal Governments handling of immigration on the border may be to some, disagreement with the federal government's immigration policy does not justify a violation of the Supremacy Clause."

Meanwhile, despite his latest legal setback, Texas Governor Greg Abbott says he will not back down and take it all the way to the US Supreme Court if he has to, saying, "We will not back down in our fight to protect our state - and our nation."

He then blamed the migration problem on President Joe Biden even though his policies are blocking federal authorities from doing their jobs at the border. He has blockaded areas into the US-Mexico border and prevented Border Patrol from patrolling certain areas.

"Texas has the right to defend itself because of President Biden's ongoing failure to fulfill his duty to protect our state from the invasion at our southern border," Abbott said.

Texas Immigration Law SB4 Being Strick Down Is a Win for Joe Biden

Texas is expected to appeal Ezra's ruling to the Fifth Circuit Court of Appeals, according to Bloomberg News. However, the ruling is already a win for President Joe Biden, who strongly opposed the law that could wrongly deport US citizens or those seeking asylum and, therefore, violate the Constitution.

The ruling also emphasizes the fact that individual states cannot create immigration laws independent of those set forth in the US Constitution, according to Bloomberg.

SB4 is also facing various lawsuits from the City of El Paso, several Latino advocacy groups, and several human rights groups.
