Ex-mob boss Joey "Skinny Joey" Merlino was sentenced to four months prison for probation violation and is sharing his plans for when he returns to the penitentiary.

A judge ruled Friday that Merlino had violated the terms of his probation after he was seen with a mob buddy in Florida in June. Merlino had been in prison from a previous racketeering conviction back in 2001.

The Philadelphia organized crime leader did not appear to be troubled by the relatively short sentence.

"I could use a good four months. Get back in shape. Get my six pack back," Merlino said as he left the federal courthouse.

The 52-year-old had planned to move south as part of a new career path. Businessman Stanley Stein told U.S. District Judge R. Barclay Surrick that he had offered Merlino a full-time job at a new restaurant called Merlino's that he is opening in Boca Raton, Florida. Stein said Merlino would work as a maître d' or host.

"We're gonna have the best Italian food in South Florida," Merlino said after the hearing. "All my mother's recipes."

But when questioned to share details of the menu, Merlino said, "I can't give you the recipes."

Merlino's mother, Rita, said that the federal government should leave her son alone so he can help with the restaurant.

"I'm tired of this country," she said, stating that the FBI should be filling their time catching terrorists and not South Philly "wiseguys."

Surrick ruled that Merlino's supervised release had been violated when he visited with mobster John "Johnny Chang" Ciancaglini at the Havana Nights Cigar Bar & Lounge. Ciancaglini was seen outside the courthouse two weeks prior at another hearing for the case.

"[The violation is] really a matter of defiance," Assistant U.S. Attorney David Troyer said. "Mr. Merlino knows what he's not allowed to do, but he does it anyhow."
