A baby born by cesarean section after a pregnant woman was killed by an elderly driver in Pittsburgh is reported to be in critical condition.

The victim, 30-year-old Jodie Guthrie, was sitting outside a drugstore on Wednesday afternoon when Allen Massie, 88, jumped a curb. Police say he was trying to park his vehicle in a parking lot, but ended up pinning Guthrie against the wall. Officials added that the senior citizen may have hit the gas instead of the brake, reports WPIX.

The accident is currently being investigated and a district attorney will decide whether or not to bring charges against Massie.

The victim's fiancé, George Weatherwalk, told reporters that baby Trace Joseph was in critical condition on Thursday, as doctors evaluate him to see if he suffered from a lack of oxygen.

According to the father, the baby has strong vital signs, but he couldn't breathe on his own at the Children's Hospital of Pittsburgh of UPMC.

"Whenever she got struck by the car, the lack of oxygen that she lost, he also lost," Weatherwalk said, according to the Associated Press. "So they're saying they don't know whether anything is wrong with his brain,"

Weatherwalk added that doctors are trying to prevent or limit brain damage in the child by keeping his body temperature at a low level.

Although there are no requirements for elderly drivers to maintain their licenses in Pennsylvania, the state does have a "mature driver re-examination program" to ensure that seniors are safe drivers. The program selects 45 random drivers out of a pool of 1,900 and mandates that they take an eye exam and a physical. If a driver has a physical or visual impairment that could affect their ability to drive, then they could be required to pass writing and driving skills tests in order to keep their license.
