While national outrage continues to brew over a New York City grand jury's failure to indict Police Officer Daniel Pantaleo in the death of Eric Garner, it turns out that the only person involved in the case that will be indicted is the man who filmed Garner's death due to separate charges.

The incident took place on July 17 when Garner, a 43-year-old black man, had a verbal confrontation with two plainclothes NYPD officers who accused him of selling untaxed cigarettes. A video recording appears to show Officer Pantaleo putting Garner in a chokehold while he was being arrested. The white cop also slammed Garner's face into the ground, ignoring the victim's repeated cries "I can't breathe." Authorities say that the asthmatic married father of six died from a heart attack about an hour after his arrest.

The cop was then cleared on all charges by a special 23-member grand jury on Wednesday, reports the New York Times. Other cops who were at the scene, including two sergeants, were given immunity in exchange for their testimony to the grand jury. 

However, Ramsey Orta, the man who recorded the video, was indicted by a grand jury on weapon charges stemming from an Aug. 2 arrest, reports SILive.com.

Cops allege that Orta stuffed an unloaded .25 caliber handgun into 17-year-old Alba Lekaj's waistband outside the Hotel Richmond two weeks ago.

"The indictment charges Orta with single felony counts of third-degree criminal weapon possession and criminal firearm possession. He's also accused of misdemeanor weapon possession," reports the SILive.com.

Orta, 22, who pleaded not guilty at his arraignment in state Supreme Court, St. George, stated that the charges are trumped up by authorities in retaliation for filming the Garner incident. His lawyer also pointed out that no fingerprints were found on the firearm.
