Mike Huckabee Sued for Playing ‘Eye of the Tiger’ at Kim Davis Rally
Republican Presidential candidate Mike Huckabee has had a lawsuit filed against him by an original founding member of the rock band Survivor.
According to Reuters, Frank Sullivan, who co-wrote the hit song "Eye of the Tiger," has filed suit against Huckabee for using the song at a Kim Davis rally, after she was freed from jail for violating her duties as county clerk in the Kentucky county of Rowan.
Many have viewed Huckabee's involvement with the Kim Davis situation as a way to score political points for his presidential campaign. The former Arkansas governor was there to greet Davis when she was released from jail, and he staged a rally for her, where she spoke in front of a crowd.
During her entrance to the main stage of the rally, Huckabee's camp arranged for the song to be played as a rallying cry for her cause, which was to deny same-sex couples marriage licenses based on her religious beliefs.
Sullivan's lawsuit claims that Huckabee and his campaign infringed on Sullivan's copyright protections by using his song without prior authorization. Sullivan holds the copyright for the song through his publishing company, Rude Music.
The song was a smash hit in the 1980s and was featured on the soundtrack for "Rocky III," which many remember as the film in which Rocky Balboa battled Mr. T. The song has since gone down in popular culture as the ultimate tune to play at arenas and sporting events.
Huckabee's campaign latched itself on to the Davis controversy following her refusal to issue marriage licenses to same-sex couples earlier this year. This followed a landmark Supreme Court ruling that same-sex couples have the right to get married in the U.S. under the Constitution. Davis' actions directly violated that ruling, which led to her arrest and incarceration.
This is not the first time that Sullivan has had to sue to get a Republican candidate to stop using the song at political events. In 2012, he also had to sue Republican presidential candidate Newt Gingrich for repeated use of the song as well. That lawsuit was settled out of court.
