An article from Miami Herald stated that some foreign citizens who entered the United States of America holding business or tourists' visas for a temporary stay in the country may want to extend their visit more than the allowed period granted by the United States Customs and Border Protection agents at different ports of entry.

There are various reasons why a traveler in the United States wants to legally extend their visit. Some of these reasons are the inability to return to their home country, shifts in their non-immigrant visa status, the petition of a family member, or marriage with a citizen of the US.

Conditions of the United States US Visa

US visas for visitors are strictly granted to travelers who possess uninterrupted intention to go back to their home abroad. Also, it does not allow the intention of immigration when applying for a visa to enter the United States.

During the presence of suspicion of a foreigner who intends to enter the United States, they are allowed to be granted entry to the United States.

The application obligates foreign travelers to showcase their intention to return to their home countries. Also, it is important to follow the declared places they plan to visit while in the country.\

To sum up the conditions, it is illicit to use a tourist visa if there is a plan of immigration in the United States. This statement is backed by the fact of their violation against the terms of their entry to the US.

90 Days after Legally Entering the United States

The first 90 days in the US for tourist visa holders are the most important part of their visit to the country.

Immigration agents closely monitor the conduct of foreigners with tourist visas in the United States in their first 90 days in the country.

If one of the immigration agents find out that the foreigner who applied for a tourist visa had worked for a job or studied in the country without securing a permit and did not disclose their intention to build a home in the US, the foreigner may be charged with an immigration fraud case.

Visitor's Visa Extension: Who is Qualified?

An extension to stay in the US after the allowed period a foreigner can stay in the country is permitted for short term problems. These short term issues can be a recovery from a medical emergency, treatment for a medical emergency, inability to fly home, family issues, and an event where a foreigner is intending to go home but is required to stay a little bit more in the US due to an unpredicted concern.

The United States Citizenship and Immigration Services issues a recommendation to foreigners who plans to extend their period in the US. It suggested that these foreigners should apply 45 days before the expiration of their authorized period of stay in the US.

Shift to a Student Classification

Foreigners who arrived with tourist visas and later identified an opportunity to study in the United States, they can ask for an extension of their tourist visas and apply for a student and exchange visitors visas.

This lets the foreigner to legally stay in the country while processing his or her student visa.
