The children of the late comedian James McNair who was killed in a highway crash received a $10 million settlement with Wal-Mart Stores Inc., Reuters reports.

McNair was killed in the car crash, and fellow comedian Tracy Morgan was badly injured in the accident on June 7.

"We are glad to have reached an agreement but we can't discuss the terms and conditions of the settlement," a spokesman for Wal-Mart said. "We deeply regret the loss of Mr. McNair as a result of the accident."

The settlement for the crash was first announced in January where terms of the agreement were held confidential.

Recent documents filed in New York's Westchester County revealed the $10 million settlement that would be split between McNair's children 19-year-old Danita and 26-year-old Jamel.

The amount of the settlement was initially held confidential for the privacy of McNair's children while the papers were filed so that a judge could approve the transaction.

McNair was killed when a Wal-Mart truck rear-ended the limousine bus he was in. The late comedian was returning from a comedy gig in Delaware with Morgan and a few other people.

Morgan was badly injured in the crash where he suffered a brain injury and several broken bones. He spent several weeks rehabilitating and hospitalized following the highway crash on the New Jersey Turnpike.

The other passengers involved in the crash along with Morgan are also suing Wal-Mart, The New York Times reports.

Morgan and the other passengers said that the world's largest retailer should have known that the truck driver, Kevin Rope, was awake for more than 24 hours before the crash and should not have been on the road.

Rope has pleaded not guilty to charges of vehicular homicide and assault-by-auto, although he was reportedly driving 65 miles per hour in a 45 mile per hour zone.
